A Scam. That's Not What was Promised

Case No: AY-5160-0624 In November 2022 AYOM Contacted me, through their facilitator Mr * ******, to discuss my case for a debt collection. We agreed a date to call to discuss. In the meantime, AYOM asked me to send all the necessary documents for them to review prior to the next phone call. One of the documents included a a confirmation that my debtor had made me a verbal unacceptable offer of £5,000 to settle the case. During the appointed 10-minute telephone call with Mr *******, I was told that AYOM will have an 85% chance of recovering the debt including the reduced AYOM fee of £1500 (Incl VAT) which AYOM would charge me. Mr ***** assured me that my case was solid. I sent AYOM all relevant documents prior to signing the contract to ensure that all is kosher, and asked AYOM to let me know if there is anything else they require. In late December the contract was signed and the agreed fee of £1500 was paid. Days and weeks passed with little progress. In mid February 2023, AYOM emailed me requesting written proof of the client's offer to settle. I reminded them of the letter (copied to AYOM in November) which I had sent to the client confirming my rejection of his verbal offer of £5,000. AYOM did not respond to that. AYOM claimed I did not inform Mr ******* (of the verbal offer) during our 10-minute phone call. I disputed that and demanded a transcript of that phone call. On 15 March, AYOM emailed me only two lines of that 10 Minute phone call which did not proof their allegation. Back and forth between AYOM and myself to no avail and without AYOM responding to my request to prove their allegations. I requested, as within my legal rights, copies of whatever correspondence or telephone contacts AYOM had with my Debtor/Client to show what efforts has AYOM made towards resolving my case. Nothing. I wrote AYOM demanding the refund of the £1500 fee paid. But they refused. They closed my case. All attempts to contact AYOM by email remained unanswered or repeating the same allegation without proof. All telephone attempts to contact Customer Services, the Legal section or Mr *******, were diverted to "Collection" who advised me that they will pass my query by email to the relevant section and urged me to wait. The last automated reply from AYOM was dated 9.6.2023 which said: "The team will respond to all client enquiries / updates as soon as possible. We are experiencing high volumes of enquiries, so please allow up-to 2 working weeks for a response. If your enquiry is urgent, please call 0333 355 7114 to speak to one of the Customer Services Team". Nothing since.. I am now going legal unless they pay up in 14 days. Reviewed on: 24th July 2023

The details given to us were what made us believe we could have success working this case. It transpired what information was given to us at the outset was not sufficient to enable us to continue the case on the initial premise. We asked for additional evidence which would support any claim you wish to make but you were unable to provide this. We dispute your claim that the case was a “total failure”. Are you owed Money is a scam company ! Not to be trusted

We hired them in May, paid 1000£ to them as a fee, we are now mid October, we have not received a penny from the money our debtor owed, despite the fact that our debtor has fully repaid them. When we hired them they never informed us they would agree to a weekly payment plan, that it would take months to possibly get our money back by monthly cheque, they do not return calls, they do not update us. We made a complaint and when we called the complaint department, they said they were too busy to take our call, I emailed the woman twice and she never answered my email, the whole point of hiring a debt recovery agency is to get the money back swiftly. Reply from Are You Owed Money The allegations of fraudulent activity in this review are slanderous and we will discuss actions regarding this review with Smart Money People. The issues addressed in this review are the same as addressed to us via this client's complaint which was handled via our procedure. As stated in our response to the initial complaint: As per the terms and conditions of our agreement, any monies recovered are subject to a minimum holding period of 90 days before being accounted to our client. This is to protect our clients, and ourselves, from the risks associated with possible clawbacks or payment disputes. Due to the nature of our industry, we are at risk of monies received being clawed back by debtors at a later date. Whether this be from a card payment, as part of insolvency proceedings or payment disputes, to name a few, we must protect the payment in order to reduce the risk associated with this. We have an article about clawbacks on our website which explains in some more detail here: https://areyouowedmoney.co.uk/ayom-blog/post/chargebacks-holding-period.php Once payments have passed the 90 day holding period, they will then be reviewed for processing by the finance department. Payments that have passed the holding period are added to the next available payment run so depending on where that falls, will depend on when a payment is going to be processed. It is not processed on the 90 day threshold as our finance department must allocate time in their schedule to complete other business duties so they consolidate the processing of payments to certain times of each month. The remaining payments are due to be processed in February and March. We are still pursuing the debtor for payment to clear the balance and I can advise on approximate processing dates for these when they come in. As this client's complaint is still in process we cannot make further comment at this time and are attempting to answer all queries while resolving the final payments of the debt which will then all be passed to this client once the funds have been marked safe from clawback. I would rate it below 0 if it was possible. The debtor paid the whole money back on November 2018. This company is holding my money. They said they have to until April because otherwise the debtor can take the money back. Now that 6 months period is over they have no other excuses. Suddenly nobody knows nothing. Customer service tells me to keep sending emails to finance and eventually they may answer as they are the only one responsible for that. Guess what I have already sent them 3 emails. First one was on 4th of April and they are not replying back. Nobody can contact them dirrectly somehow. Only emails that they ignore. This is ridiculous. Do not ever think about using them. Waste of nerves and time. After I went to court against debtor to get the warrant it seems like they are the next one on the list. Reviewed on: 25th April 2019
